Still recovering from the hangover called the 80s? So are we, and apparently a few have only just come out of their stupor with a recnt lawsuit pitting 80s hair metal bands against each other.
According to The Hollywood Reporter Poison, fronted by modern day reality tv star and Miley Cyrus’ mums occasional squeeze Bret Michaels, is being sued in the Illinois Federal Court by Billy McCarthy and James Stonich, who were members of a Chicago band known as Kid Rocker.
The lawsuit alleges the theft not of any recent work, because let’s be honest none of these guys have done anything noteworthy for years, but of classic hits such as “Talk Dirty To Me,” “I Won’t Forget You,” “Fallen Angel” and “Ride the Wind.”
Never heard of Kid Rocker? Neither had we. But apparently they were signed to Atlantic Records and were a staple of the Hollywood club scene in the early 80s. According to the plaintiffs before Poison guitarist C.C. DeVille joined Poison, he auditioned for Kid Rocker all the way back in 1984. At the time he was lent master-recorded studio tapes of new Kid Rocker songs.
Kid Rocker broke up later that year. DeVille then joined Poison who went on the sell over 4 million records with their debut album Look What the Cat Dragged In, instantly making them an icon of glam rock. That was 25 years ago, but bitter of all the money that DeVille and his bandmates have made, Kid Rocker now want all the profits made from the songs in question and are asking the judge to grant them an injunction to prevent Poison and Michaels from performing the songs.
If you’re asking why it took so long for Kid Rocker to sue Poison we think their attorney sums it up best simply replying that it is a “good question”. The case continues.
