Ruby Tuesday is an American burger chain. It is also the name of a very famous Rolling Stones song. There’s also a band from Wollongong called Ruby Tuesdays. Now the burger chain is suing the Aussie band because apparently they stole it from them.

Yes a burger chain that is named after a song is suing a band with the same name for copyright. How much are they suing for you ask? $2 million. Quite a lot of money for the self described “Penniless five piece rock/fusion band.”
The band told Munchies they have no plans to go to court and maintain they did not name themselves after the burger chain. “We had never heard about the restaurant chain before this. We got our name from the Rolling Stones song, as did they.”
The copyright infringement lawsuit states “While many artists pay tribute to other artists through imitation, when it comes to imitating famous trademarks, only Ruby Tuesday is entitled to the goodwill of its mark”. which is just odd because if you remember, the burger chain is also named after the song.
On top of the $2 million, the American chain also wants the band to destroy all their merch, take down their website, and give them any profits they’ve made. However the band hasn’t really made any profits yet so that’s an issue.
Sales of their merchandise have risen since the band appeared on The Project on Sunday. With the Illawara Mercury reporting that people from all over Australia have ordered shirts. The band have hired an attorney and are hopeful the case will not go to court.
